The Agreement

By booking a portrait session with Speak Pixels by Rachon Denae (“Speak Pixels,” “I,” “me”), you (“Client”) agree to the terms outlined here. These terms apply to all portrait sessions, product orders, and related services provided by Speak Pixels.

A session is considered confirmed upon receipt of a signed contract and retainer payment. Consultations are complimentary and do not constitute a booking.

Retainer & Payment

A non-refundable retainer is required to hold your session date. The retainer amount will be specified in your booking contract and applied toward your final balance.

The remaining balance is due at or before your Reveal Appointment. Collections and products must be paid in full before delivery of prints or albums.

Speak Pixels accepts payment via the methods outlined in your booking contract. Returned payments are subject to a $35 fee.

Cancellations & Rescheduling

By the Client: Your retainer is non-refundable regardless of cancellation reason. If you need to reschedule, you may do so one time at no charge with at least 72 hours notice. Rescheduled sessions must occur within 90 days of the original date.

Cancellations with less than 48 hours notice may forfeit the retainer and require a new retainer to rebook.

By Speak Pixels: In the rare event that I must cancel due to illness, emergency, or circumstances beyond my control, I will reschedule your session at no additional cost or issue a full refund of your retainer.

Session Day

Sessions begin at the scheduled time. Late arrivals reduce session time accordingly. If you are more than 30 minutes late without prior notice, the session may be forfeited and the retainer will not be refunded.

Please arrive with hair and makeup complete (unless a makeup artist is included in your package), with wardrobe prepared on hangers in a garment bag.

Speak Pixels reserves the right to end a session early if a client is disrespectful, threatening, or otherwise creates an unsafe environment.

Image Selection & Delivery

Final image selection takes place at your Reveal Appointment. Images are delivered via an online gallery through Sprout Studio within the timeframe specified in your booking contract.

It is the Client’s responsibility to download and back up all digital images upon delivery. Speak Pixels retains edited images for a minimum of 90 days following delivery, after which they may be archived or removed. Re-delivery after the 90-day period may incur an archival retrieval fee.

Unedited, raw, or rejected images are not available for purchase or delivery under any circumstances.

Copyright & Image Use

All images created by Speak Pixels are the intellectual property of Rachon Denae and are protected by U.S. copyright law. Purchasing a portrait session grants the Client a personal, non-commercial license to use the delivered images for personal use — including sharing on social media and printing for personal display.

The following uses require prior written permission from Speak Pixels:

• Commercial use, advertising, or paid promotion
• Sale or licensing of images to third parties
• Significant alteration, cropping, or filtering of delivered images
• Use of images to promote a competing photography business

When sharing images on social media, clients are encouraged (but not required) to credit @speakpixels.

Speak Pixels retains the right to use session images for portfolio, website, social media, and marketing purposes unless a written privacy agreement is in place.

Products & Prints

All print products (albums, folio boxes, framed prints, canvas wraps, loose prints) are custom-made to order. All sales are final once production has begun. Please review all orders carefully before confirming.

Products are produced by professional boutique labs. Minor color variation between screen preview and printed product is normal and does not constitute a defect.

Damaged products will be replaced at no cost when reported within 7 days of delivery with photographic evidence of the damage.

Minors

Clients under 18 years of age must have a parent or guardian present for the duration of the session. The parent or guardian must sign all contracts and is responsible for all payments.

Images of minors will not be used for portfolio or promotional purposes without explicit written consent from a parent or guardian.

Limitation of Liability

Speak Pixels will make every professional effort to deliver exceptional portraits. However, in the event of equipment failure, illness, or circumstances beyond reasonable control, liability is limited to a refund of the retainer paid.

Speak Pixels is not responsible for dissatisfaction arising from client preparation issues, including unprepared wardrobe, failure to follow prep guidance, or significant changes to appearance between booking and session date.

Governing Law

These Terms are governed by the laws of the State of Texas. Any disputes arising from services provided by Speak Pixels will be resolved in Rockwall County, Texas.
